Wikinews currently has a policy restricting image uploads to those accepted by Wikimedia Commons. This means that all images uploaded there have to use a "free" license, as defined by the Commons Licensing page.

If Wikinews starts accepting Wikinews-specific uploads, these uploads will have to follow the policy outlined here.

This policy is meant to apply to images only, but may at a future date extend to other media accepted by the Upload process.

Free images

Images that fit the criteria of Wikimedia Commons should be uploaded there and not locally to Wikinews. These images may be used by all Wikimedia projects, as well as any derivative works, or any commercial uses of the projects. This is the preferred method of uploaded images.

Fair use images

Images can be accepted locally if they fall under the fair use defense. Since Wikinews is a news organization, the fair use defense would not apply to images from other news web sites, or blogs. However certain logos, publicity photos, and some screen shots may be used on the site under this clause.

Specifically, images that are part of "press kits" or are otherwise made available for press use can be uploaded locally.

Wikinews has a general policy on fair use which governs this issue.

Grants of license

Wikinews may be granted an explicit license to use particular images, even if the image remains under the copyright. The uploaded image must have the name of the copyright holder in the description. The description may also contain the name of the user who arranged the license grant. If Wikinews was granted a license in situ — in a statement on the copyright holder's web site, for example — the grant statement should be included instead.

Images with license grants may be subject to certain requirements. This may include their use in derivative works, requirements of attribution, or their use in only non-commercial works. These restrictions must be clearly noted in the image description. Images with attribution must be attributed in every article where they are used.

Images with a grant of license must be uploaded to Wikinews locally, and not to the Wikimedia Commons.

Under this clause of the policy, images that are licensed for anyone's use, but are limited only for non-commercial reproduction may be uploaded to Wikinews. In doing so, the entire copyright notice for that image also must be copied and posted to the image's text area. This informs commercial sites wishing to syndicate Wikinews material that they may take the story's text, but cannot use the limited use image without permission from the copyright holder.
